5. PUBLIC HEARINGS

S23-0002a Hold a public hearing and consider adoption of an ordinance of the City of Denton, Texas approving a Specific Use Permit to allow a building no more than 53 feet in height on approximately 2.659 acres of land generally located at the southwest corner of the intersection of Stuart Road and Loop 288 in the City of Denton, Denton County, Texas; adopting an amendment to the City's Official Zoning Map; providing for a penalty in the maximum amount of $2,000.00 for violations thereof, providing for severability and an effective date. The Planning and Zoning Commission voted [3-2] to recommend approval of the request. Motion for approval by Commissioner Pruett and second by Commissioner Cole. THE APPLICANT IS REQUESTING TO POSTPONE THIS ITEM TO A DATE CERTAIN OF NOVEMBER 7, 2023 (S23-0002, Stuart Apartments, Mia Hines).
