ID 22-1227 Consider adoption of an ordinance ordering a recall election to be held on November 8, 2022 for the purpose of determining whether City Council Member Alison Maguire shall be removed from District 4 of the City Council by recall; prescribing the time, manner, and conduct of the election in accordance with an Election Agreement and Contract for election services with the Election Administrator of Denton County; and providing an effective date.

    This is a waste of time and resources. Ms. Maguire has not conducted activities worthy of a recall election.

    I oppose the petition brought by people who did not live, vote in the district in May 2021 election. The subject has not been found incompetent by a probate court nor has been charged with a crime of malfeasance and misconduct. Council could be left with a vacancy. Do not make a mockery of elections and squander tax-dollars by holding a date a needless election. The May 6, 2023 election is the appropriate venue for making a change.

    It is still a question as to the validity of the signatures on the petition to have Alison Maguire recalled. The City cannot act on this based on the question of whether this document is legal. Most of the signatures were from people not in her district when she was elected. The City must follow the law.

    Is there not a pending lawsuit about this recall petition? Is it not true that many of the signers of Mr. Duff's petition did not even vote for Ms Maguire in the pre-district change election? And, if those voters were removed from the petition there would not be the prerequisite number of voters to validate the recall? This is a frivolous action and there should be something added to the City Charter to prevent this sort of foolishness in the future.
